Cheque Bounce

This complaint under Section 138 of the Negotiable Instruments Act is filed seeking appropriate action against the accused for dishonour of the cheque issued towards a legally enforceable debt. The complainant submits that the accused had issued the cheque in discharge of outstanding liability, but the same was returned unpaid due to “insufficient funds,” causing financial loss and mental harassment. Despite receiving the statutory demand notice within the prescribed time, the accused deliberately failed to make the payment. The complainant has complied with all legal requirements, including timely presentation of the cheque and issuance of notice. The conduct of the accused shows clear intention to evade payment and misuse the banking system. The dishonour of the cheque amounts to a criminal offence under Section 138. Therefore, through this complaint, the complainant respectfully prays that this Hon’ble Court take cognizance of the offence, summon the accused, and ensure repayment along with appropriate compensation in the interest of justice.
